We at Sendwithus, owned by Techdrop Labs Inc. and including our U.S. subsidiary Techdrop Labs (DE) Inc. (“Sendwithus,” “we,” “us,” “our”) know that our users (“you,” “your”) care about how your personal information is used and shared, and we take your privacy seriously.  Please read the following to learn more about our Privacy Policy.

Techdrop Labs offers a service under the name Sendwithus (the “Service”). Techdrop Labs collects information from individuals who visit the Company’s Website (“Visitors”) and individuals who register to use the Service (“Customers”).

I. Information Collected

When expressing an interest in obtaining additional information about the Service or registering to use the Service, Techdrop Labs requires you to provide personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”).

When purchasing the Service, Techdrop Labs requires you to provide the Company with financial qualification and billing information, such as billing name and address, and credit card number (“Billing Information”).

Techdrop Labs may also ask you to provide additional information, such as industry, company revenues, or number of employees (“Optional Information”).

Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Techdrop Labs Customers.”

As you navigate the Company’s Web site, Techdrop Labs may also collect information through the use of commonly-used information-gathering tools, such as cookies and Web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s Web site (such as the Web pages viewed and the links clicked). II. Use of Information Collected

The Company uses Data About Techdrop Labs Customers to perform the services requested.

For example, if you fill out a “Contact Me” Web form, the Company will use the information provided to contact you about your interest in the Services.

Techdrop Labs uses Contact Information for account access, service notifications, and other purposes related to use of the Services.

Techdrop Labs uses credit card information solely to check the financial qualifications of prospective Customers and to collect payment for the Services.

The Company may also use Data About Techdrop Labs Customers for marketing purposes. For example, the Company may use information you provide to contact you to further discuss your interest in the Services and to send you information regarding the Company and its partners, such as information about promotions or events.

Techdrop Labs uses Web Site Navigational Information to operate and improve the Company’s Web site. The Company may also use Web Site Navigational Information alone or in combination with Data About Techdrop Labs Customers to provide personalized information about the Company.

III. Public Forums, Refer a Friend, and Customer Testimonials

Techdrop Labs may provide bulletin boards, blogs, or chat rooms on the Company’s Web site directly or via third-party services. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Techdrop Labs is not responsible for the personal information you choose to submit in these forums.

Techdrop Labs may post a list of Customers and testimonials on the Company’s Web site that contain information such as Customer names and titles. Techdrop Labs obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.

IV. Sharing of Information Collected with Third Parties

Techdrop Labs may share Data About Techdrop Labs Customers with third parties such as the Company’s service providers so that these service providers can contact Customers and Visitors who have provided contact information on our behalf. 

Techdrop Labs may also share Data About Techdrop Labs Customers with the Company’s service providers to ensure the quality of information provided. Unless described in this privacy statement, Techdrop Labs does not share, sell, rent, or trade any information provided with third parties for their promotional purposes.

Our service providers may be located outside of the United States; however, we will either obtain your explicit consent to transfer Data About Techdrop Labs Customers to such third parties, or we will require those third parties to maintain at least the same level of confidentiality that we maintain for such information ourselves. We remain liable for the protection of your information that we transfer to third parties, such as our service providers, except to the extent that we are not responsible for the event giving rise to any unauthorized or improper processing.

From time to time, Techdrop Labs may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from Techdrop Labs, the Company may share Data About Techdrop Labs Customers collected in connection with your purchase or expression of interest with our joint promotion partner(s). 

Techdrop Labs does not control our business partners’ use of the Data About Techdrop Labs Customers we collect, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.

Techdrop Labs uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf.

Techdrop Labs reserves the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with official investigations or legal proceedings initiated by governmental and/or law enforcement officials, or private parties, including but not limited to: in response to subpoenas, search warrants, or court orders, to meet national security or law enforcement requests; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Techdrop Labs, our employees, our users, or others.  This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

If we must disclose your Personal Information in order to comply with official investigations or legal proceedings initiated by governmental and/or law enforcement officials, we may not be able to ensure that such recipients of your Personal Information will maintain the privacy or security of your Personal Information.

V. International Data Collection and Transfer

The Company’s Web site and Services are hosted in the United States. If you are accessing the Web site and/or Services from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal data as described in the section “Sharing of Information Collected.” 

Where European Union data protection laws are applicable to the processing of your personal data and if we need to transfer your personal data to third countries, as defined in European Union data protection laws, we will ensure that this will be subject to appropriate safeguards and other requirements as required by applicable law. Such safeguards include our U.S. subsidiary Techdrop Labs (DE) Inc. complying with the EU-U.S. Data Privacy Framework (as described in the section “EU-U.S. Data Privacy Framework”).

To facilitate Techdrop Labs global operations, the Company may transfer and access Data About Techdrop Labs Customers from around the world, including the United States. This Privacy Statement shall apply even if Techdrop Labs transfers Data About Techdrop Labs Customers to other countries.

VI. EU-U.S. Data Privacy Framework

Techdrop Labs (DE) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) as set forth by the U.S. Department of Commerce. Techdrop Labs (DE) has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern.

VII. Dispute Resolution

In compliance with the EU-U.S. DPF, Techdrop Labs (DE) commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF to the VeraSafe Data Privacy Framework Procedure, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles related complaint to your satisfaction, please visit https://www.verasafe.com/privacy-services/dispute-resolution/submit-dispute/ for more information or to file a complaint. The services of the VeraSafe Data Privacy Framework Procedure are provided at no cost to you.

VIII. Binding Arbitration

If your dispute or complaint cannot be resolved by us, nor through the dispute resolution program established by VeraSafe, you may have the right to require that we enter into binding arbitration with you pursuant to the Data Privacy Framework’s Recourse, Enforcement and Liability Principle and Annex I of the Data Privacy Framework.

IX. Regulatory Oversight

Techdrop Labs (DE) Inc. is subject to the investigatory and enforcement powers of the United States Federal Trade Commission.

X. Data Subject Rights

If you are a data subject about whom we store Personal Information, you may have a right to request access to, and the opportunity to update, correct, or delete, such Personal Information. To submit such requests or raise any other questions, please contact us at legal@sendwithus.com.

Techdrop Labs acknowledges the right of EU individuals to access their personal data pursuant to the Data Privacy Framework and will grant individuals reasonable access to personal information it received pursuant to the Data Privacy Framework Principles. In addition, Techdrop Labs will take reasonable steps to permit individuals to correct, amend, or delete such information that is demonstrated to be inaccurate or processed in violation of the Principles. If we have received your Personal Data in reliance on the Data Privacy Framework, you may also have the right to opt out of having your Personal Data shared with third parties and to revoke your consent to our sharing your Personal Data with third parties. You may also have the right to opt out if your Personal Data is used for any purpose that is materially different from the purpose(s) for which it was originally collected or which you originally authorized. An individual may request to access their information, or otherwise correct, amend, delete, or limit use and disclosure of their information in line with the EU-U.S. Data Privacy Framework Principles by contacting us at legal@sendwithus.com.

XI. Communications Preferences

Techdrop Labs offers Customers and Visitors who provide contact information a means to choose how the Company uses the information provided. You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of the Company’s marketing emails. Additionally, you may send a request specifying your communications preferences to support@sendwithus.com. Customers cannot opt out of receiving transactional emails related to their account with Techdrop Labs or the Services.

XII. Correcting and Updating Your Registration Information

Customers may update or change their registration information by logging in to their accounts at https://app.sendwithus.com/login. Requests to Techdrop Labs to modify or delete your information will be handled within 30 days once customer account ownership has been verified.

XIII. Security

Techdrop Labs uses appropriate administrative, technical, and physical security measures to protect Data About Techdrop Labs Customers.

XIV. Changes to this Privacy Statement

Techdrop Labs reserves the right to change this Privacy Policy. Techdrop Labs will provide notification of the material changes to this Privacy Policy through the Company’s Web Site at least thirty (30) business days prior to the change taking effect.
